30 Dec 09 The Biased Judiciary

The Judges of courts are sitting on a” Responsible “and “Accountable “position. They have to be “unbiased “and” unprejudiced” in the court proceedings as well as in giving Judgments without any partiality after thoroughly hearing and studying the pros and cons of each case.

Since in the recent past many such laws like the “Section 498A”, ”The Domestic Violence Act “, “Section 125 CrPC”, “Child Custody” etc. are being “Misused” by the greedy and  malicious ”young wives” who on some “False Complaints” and “Concocted Allegations” on their in-laws, harass  a whole family  for their “Personal Scores” or “Monetary” Gains”.

We have surveyed many such cases where the judges are “Biased and Prejudiced” towards the “Husband and his family” and “Over-Protective and Supportive” towards “Adulterous Wives” in passing orders of “Maintenance and Alimony” even knowing that it is a False Case; the judges are reluctant to give judgments in favor of a “Husband” as he is already supposed to be guilty and criminal before being proven one. They think it is their moral and ethical duty to support even ‘Adulterous  Wives” by granting them favors, making adjournments by giving unnecessary dates to drag the case and finally giving a “Judgment” which  is not justified as it is based on the presumption  of  the “Allegations” to be true without the necessity of them being  verified. They are accepted as “Gospel Truth’ from times immemorial.

NCW and WCD:

In the recent past a lot has been said about “Women Empowerment” by the National Commission for Women (NCW) and the Women and Child Development Ministry (WCD) Ministry. But not much has been done in practicality.

The reality:

On Saturday the 21st Nov 2009 a program titled “NAMAK” was telecast on the DD News channel at about 3 P.M. Very strange but true facts have come out in the open. In a remote village of Kutch named “Khargoda” which is ironically called the “WIDOW’S VILLAGE” since in most of the families there are widows living below the poverty line (BPL). Their children are undernourished with no means of proper education and not even provided with the basic necessities of life. The widows find it very difficult to cope with such poverty due to lack of livelihood as they do not get the means to earn a living. Their husbands had died because while working in salt manufacturing industries, by contracting skins diseases and other ailments sans proper treatment. It is miserable to see their pitiable conditions.

13 Nov 09 Old woman bitten by daughter-in-law

In a weird incident, during a proverbial argument between a mother-in-law and her daughter-in-law, the latter is reported to have beaten up and bitten her mother-in-law. A case has been registered against the daughter-in-law in Kasna police station on the complaint of the mother-in-law.

According to reports, Vijaya Kapoor, the victim, lives in Tata Authority Officers’ enclave in Sector Beeta with her husband and employed as an officer in another company. Their son and daughter-in-law live in Faridabad, and they had come to Sector Beeta to meet their in-laws.

About two days ago, Vijaya Kapoor had come to Sector Beeta. On Sunday, both the them clashed on some point and the argument lead to fisticuffs and exchange of blows between the two women. While both the women were rolling, daughter-in-law bit her mother-in-law sinking her teeth at various parts on her body. Soon Vijaya Kapoor’s husband reached there on hearing her wife’s shrieks and rescued her from the clutches of the daughter-in-law. After this, Vijaya Kapoor rushed to Kasna police station and lodged a written report against her daughter-in-law. The police have registered a case against the daughter-in-law.

11 Nov 09 Debate on misuse of family law

Bengaluru, Nov. 10: Akhila Karnataka Aththeyara Rakshana Vedike (Mothers-in-laws Association) in association with the Save Indian Family Foundation and the Child Rights Initiative for Shared Parenting will observe the National Family Harmony Day by holding a debate on the misuse of IPC section 498a (cruelty against women by spouses and other family members) in Bengaluru on Thursday. As per the National Crime Record Bureau, 1,23,000 women have been arrested between 2004 and 2007 under section 498a.

However, a report from the Centre for Social Research has revealed that only 2 per cent of such dowry harassment cases receive conviction, implying that the remaining has been victims of legal misuse as well, said Janaki Srinivasan, member of the Akhila Karnataka Aththeyara Rakshana Vedike. Over 200 mothers-in-laws from across the country are expected to take part in the meeting to be held between 2 pm and 5 pm at the Shaneswara Temple Hall at Hanumanthnagar

BANGALORE — Each week, in a corner of Bangalore’s historic Cubbon Park, a group of men and women gather to swap stories and vent their emotions. They are part of the newly launched All India Mother-in-law Protection Forum.

It is a motley gathering of teachers, retired air force officers, doctors and software engineers, all educated, urban Indians drawn together by a common cause.

They are “victims,” who have banded together to fight the harassment and abuse they say they endure at the hands of the rude, domineering, greedy young women who marry into their families.

A hundred or more members attend these weekly sessions in Bangalore, a trend that sociologists say reflects the breakdown of traditional roles in India’s fast-changing urban society.

“These groups are a response to the growing tensions and ruptures within the established Indian family system,” said professor A. R. Vasavi of the National Institute of Advanced Studies in Bangalore.

28 Oct 09 ‘HARASSED’ MOTHERS-IN-LAW FORM UNION

In the wake of filing of thousands of criminal cases under the new Domestic Violence Act by the daughters-in-law on flimsy grounds, several ‘harassed’ mothers-in-law have launched Andhra Pradesh Mothers-in-law Protection Association (APMPA) to protect the rights and interests of senior women in the state here.

Speaking to media persons here on Sunday, the Andhra Pradesh Mothers-in-law Protection Association (APMPA) spokesperson, Ms Padmaja, demanded that the government reform the present “wife-centric” domestic violence law giving equal protection to the mothers-in-law.

The All Forgotten Women Forum president, Ms Uma Challa, said that in the last four years, over 1,23,497 women, most of them being mothers-in-law, were arrested under 498-A IPC alone not for committing any crime under the law, but because they were related to a man.

The famous women’s right activist, Ms Madhu Kishwar, acknowledged the fact that IPC Section 498-A was misused and that a significant number of individuals who approached “Manushi” these days are mothers -in-law and husbands who were falsely accused of marital cruelty and dowry harassment. She said that APMPA would strive towards protection and welfare of such mothers-in-law in distress by creating awareness, giving them moral support and counseling.

The APMPA is the Andhra Pradesh chapter of All India Mothers-in-law Protection Forum, which was launched on September 6 this year at Bengaluru, followed by the launch of local chapters in Delhi, Nagpur, and Lucknow. She said that mothers-in-law were being discriminated against is spite of their generosity just for the sin of giving birth to sons and getting them married and were being forced to part with their earnings, savings and inherited wealth. They were also being thrown out of their own property at the behest of a disgruntled daughter-in-law. The APMPA would appoint president and other members next month, she added.

HYDERABAD: It was a saas drama to the fore at Public Gardens in the city on Monday.

A ‘social forum’ which goes by the amusing nomenclature of Andhra Pradesh Mothers-in-Law Protection Association (APMPA) was launched on Monday to protect the rights of harassed mothers-in-law in the State.

The APMPA is the AP chapter of already launched All India Mothers- In-Law protection forum.

Several women, supported by their sons, against whom cases of dowry harassment and domestic violence are pending put in an appearance. The women had a common complaint — the IPC 498 A or the Dowry Harassment Act was being misused by their bahus. Venugopal, a private IT employee against whom one such case is pending said, “In our society, there is a preconceived notion that mothers-in- law are bad. Finding the loopholes in the law, some wives are creating legal terrorism. The IPC 498 A is grossly misused for taking revenge or inciting hatred against the in-laws by the wives. According to statistics, 1,25,000 people are jailed because of complaints filed by daughters-inlaws and 98 per cent of them acquitted at a later stage. This shows how the Act is being manipulated with.” A member of the organisation and a mother-in-law, B Kowsalya shared her ‘bitter experience’. “My third son got married a few years back. After a while, the girl started beating him up and fought with the womenfolk of the house. She filed Sec 498 A against us. My son had to go to the police station frequently and we had to face a lot of mental trauma.” Another mother-in-law joined in to say that she lost her husband because of the “torture” they were subjected to as a result of the complaint filed by their daughter-in-law. She claimed that her daughter-in-law did not want to stay with the in-laws and so filed a police complaint. (more…)
