06 Feb 10 Domestic Violence Act or Demoralized and Violated Act
The Domestic Violence Act was passed in 2005.and implemented in 2006 for the protection of women (Wife). But the Law-Makers have completely forgotten or rather ignored the fact that violence can be inflicted by the same wife on the members of the family either mentally, physically, emotionally, verbally, socially and financially in order to gain personal scores, to have financial control or to separate the husband from the parents. According to the law, only the wife can make a complaint and it does not require any proof for her to claim maintenance from the husband. With fabricated stories and crocodile tears she can easily register a false case .The judges feel it is their duty to protect even adulterous wives thus doing injustice to the victim husband and his family.
Each individual coming together make a family and a home. Many homes taken together make a society, a village, a town, a city and a country. But in India gradually the society is breaking up due to the domestic violence happening in each and every home. Why is it that in every family problems start only after a daughter in-law enters the home?
The Government is spending enormously in combating terrorism on the borders of the country but when will the issue of domestic terrorists in the guise of daughter- in- law who Misuses the laws and creates havoc in the families be properly tackled.
Thousands of daughters-in-law have filed criminal cases on their in-laws on flimsy grounds only with the intention to harass and humiliate them and to extort money. Many such victimized mothers-in-law have founded the AIMPF (All INDIA MOTHERS-IN-LAW PROTECTION FORUM) in Bangalore on the 6th of Sept. 2009 followed by similar launch of local chapters in Delhi, Nagpur, Hyderabad, Chennai, Chhattisgarh and Lucknow. More local chapters are yet to open shortly.
The famous women rights activist, Madhu Kishwar has acknowledged the fact that the IPC Section 498A and the Domestic Violence Act are Misused and a significant number of individuals who approached Manushi these days are mothers-in-law and husbands falsely accused of marital cruelty and dowry harassment. She further said that AIMPF would strive towards the protection and welfare of such mothers-in-law in distress by creating awareness, giving them moral support and counseling them.
In the last four years 1, 23,497 women who are mothers-in-law and sisters-in-law (husband’s relatives) were arrested under 498A and also accused of domestic violence for not committing any crime under the law but because they were related to a man.
The Government should reform the present Wife-centric domestic violence law giving equal protection to the mothers-in-law and even to the husbands and children thus including every member in the society who deserve protection irrespective of gender.
Mothers-in-law are being discriminated against in-spite of their generosity just for the sin of giving birth to sons and getting them married. They are being forced to part with their earnings, savings and inherited wealth. They are also being thrown out of their own property at the behest of disgruntled daughter-in-law.
Save Family Foundation and My Nation Foundation had conducted an online survey between April 2005 and March 2006 and found that out of 1,00,000 men surveyed 98% of men faced severe domestic violence at the hands of their wives and in-laws in the form of verbal, physical, mental, emotional and financial abuse
1. Economic violence was the commonest faced by 32.8%.
2. Physical violence was the closest second at 25.2%
3. Emotional violence followed suit at 22.2%
4. Sexual violence contended fourth with 17.7%
5. Verbal abuse was a problem faced by all men in the above categories.
The gruesome reality is that men suffer in silence for the fear of being discredited or ridiculed in the society. This has resulted in a lot of psychological imbalance, sometimes irreparable damage to the abused male and his family. Even the society believes that men who face domestic violence are somehow responsible for it and should be made to pay the price. This is the reason why the society does not accept/support weak men or men who are victims of domestic violence
The Protector and the Provider of the Family (Male) suffers domestic violence from boyhood to manhood in many ways. Domestic violence can inflicted on employees and servants too can be victims of it, then why only the Wife is taken into consideration under this Act?
Although this Act is propagated by the lawyers and supported by the NCW even the Judiciary is equally responsible for the present condition of the society. From times immemorial the judges avoid listening to a man and without any verification or checking the evidences blindly support the woman. The Disgruntled Wife is thus successful in having orders passed in her favor.
The day is not far when men will refuse to Marry, where will the young, greedy women go then and what will be the future generation?
International studies the world over, including those done by Murray Strauss have proved beyond reasonable doubts that both men and women are equally likely to face domestic violence from their Partners and immediate family including a woman in her natal home by her own parents.
Thus Domestic violence is NOT A ONE GENDER ISSUE as vouched by the Feminists, advocated by the Lawyers, presented by the Media envisaged by the Government, and justified by the Judiciary.
It is rather a SOCIAL ISSUE and needs to be addressed as a social problem only where in there are no ubiquitous and stereotypic assumptions, no double standards and punishment should be CRIME-BASED and not Gender based.

The third Report of THE NATIONAL FAMILY SURVEY Referred in COMMENTS dated Dec 30, 09, The psycodynamics are appropriately concluded and are scientific. Such wives are called TOXIC wives who are on a look out for a soft and rich targets for mother-in-law and sons to displace their violence and neglect of her natal home on to the soft targets, especially of single mother and son. Thy are sympathy seekers, manipulative, paranoid, obsessive and has a cancserous narcisstic and has a torrent personality as referred as evil personality by the psychiatrist, M. SCOTT PECK in his book “PEOPLE OF LIE” after his book “THE ROAD LESS TRAVELLED”. Hence the victim complaining if domstic violence aught to be thoughrouly assesd for her personality and emotional intelligence. Such people are criminals and need to be punished for an example for others not to repeat. NCW need not to get foreign funds for 498A instead do their homework and bring the truth out.
I am one of the victim of this rediculous act. I dont understand why this is all happening even everyone knows that it’s a crual act against men. No one wants to discuss & interests in this.At the time of forming,may be it was a fair decision, but now it is absolutely cruality on humankind. we should stand together against this violence act.
It is important that you look beyond the few exceptions in society and look at the large number of women (thousands of them) who are in desperate need for such acts because they are victims of abuse. Nobody says that all men are evil and all women good but the fact remains that women have been the easier targets for exploitation for centuries. This is the reason that there are legal proceedings which provide men and women the opportunity to defend themselves before prosecution. So if you are innocent and if few women are really taking advantage of such acts, it can be brought out during the proceedings.
As for your threat regarding men refusing to marry, i think it would be a blessing in disguise for all and maybe men should do so because in the words you have used to describe wives, clearly they are women with no moral, social or ethical grounding. It is interesting to see that the same women if mothers-in-law or sisters-in-law are victims. As for your question about why the problems only start after the entry of a daughter-in-law, well, that is because families are different and its difficult for a young girl to be patient and accomodating all the time. The same also applies to the family members who are used to a certain lifestyle and practices, and sometimes find it difficult to accomodate the entry of a daughter-in-law or are wary of her “character”.
Please look at all viewpoints and don’t go on harping on one side of the argument without an understanding of the realities. It does not make you a responsible citizen or even an intelligent one. You have only showcased your ignorance of the larger picture.

You are on your way to becoming a Militant feminist . to whom even the talk of men’s rights is an attack on women. Men and their families are disposable isn’t it , that’s what you think or believe ?
So you state that an daughter in law who has the vices of being impatient and non adjusting gives her the right to use the Domestic Voilence against her husband and his family , and even if the husband’s family really had done something then why is that 98% of dowry cases and 85% of DV cases turn out to be false in the beginning of the trial itself despite having such sweeping Anti Male provisions like assuming the females versions to be the truth to begin with.
Also why is it that after filing dowry and DV cases women are least interested in punishing the husband( for his so called crime) but are more keen on “settling” things after payment of huge money ?
498A and DV are different in the way that they offer free money and arrest on demand provisions unlike the other Indian laws . Why does not use sections of “Hurt” , or “Grievous Hurt” where it has to be proved that she has been really been hurt in some way. The IPC had enough laws to tackle all the issues men and women face but even then 498A and DV were created with the sole motive of legal extortion of MONEY and nothing more .
Women suffering today is an BIG exception and not women misusing the law. Right from times immemorial kings and emperors have suffered due to irresponsible behavior of women in their lives and this is also present in the Ramayana and Mahabharata .Coming to India , an independent study of DV of 32 countries including India by MA Strauss says that DV in India is initiated more by women and in most cases the DV is mutual . So if DV is initiated more by females and is mutual most of the times then why does the law penalize only men?
When women demand equal opportunity in all aspects of life then why do they demand preferential treatment in employment , courts and government benefits ? DV Act must be made gender neutral and Men and women must be equally held guilty of the offense .
The Indian laws are not only unconstitutional but badly drafted and worded and offers no punishment for abuse and misuse. In fact it invites misuse and offers a free license to women.As far as men not marrying is concerned , that’s not going to offer relief as the ambit of wife is being widened so that women who have a one night stand can also claim DV and 498A abuse and claim money. Pls give statistics on how many women have been helped by these laws? According to IPC 498a statisitics in Bangalore, only 1 person is convicted for every 150 people (including women) arrested and put to trial. So to supposedly protect 1 woman, several women are arrested and go through trial and acquitted in the end!

Women don’t have to defend against any prosecution, because a husband can hardly file a case against woman under Indian laws except ask for divorce on cruelty grounds. A woman can file Domestic Violence case against man if she simply feels like on that day!

How about you going to jail (not after conviction – just as soon as your spouse complaints) because you asked your spouse to see the soap later because you wanted to watch the TV match (this is a weird definition on mental harassment – but only for women).
I will ask you a question and I hope you will be intelligent enough to understand the analogy. If there are 2 suspected terrorists hiding in a crowd of 10,000 people, what will you do? Kill all the 10,000 people OR save identify 99,998 people and identify the 2 suspected terrorists?
Apparently the scenario with the implementation of these laws (498a and DV) is akin to the former scenario.
